The terms governing your use of unschoolly

Welcome to unschoolly! These Terms & Conditions ("Terms") constitute a legally binding agreement between you and unschoolly, a company registered in Estonia, European Union.
By accessing or using unschoolly, you agree to be bound by these Terms. If you do not agree, please do not use our services.
1. Service Description
unschoolly is an educational platform designed to help homeschooling families create personalized lessons based on the International Baccalaureate Primary Years Programme (IB PYP) framework. Our services include:
- AI-generated lesson plans across multiple subjects
- Progress tracking and analytics
- Gamification features (badges, achievements)
- Teaching resources and downloadable PDFs
- Parent and learner management tools
- Referral program (optional participation)
2. Eligibility and Account Registration
2.1 Age Requirement
You must be at least 18 years old to create an account. unschoolly is designed for use by parents or legal guardians on behalf of their children. We do not knowingly allow children under 18 to register independently.
2.2 Account Information
You agree to provide accurate, current, and complete information during registration and to update it as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
2.3 Account Security
You must notify us immediately if you suspect any unauthorized access to your account.
3. Subscription and Payment Terms
3.1 Free Trial
We offer a 7-day free trial for new users. No credit card is required to start the trial. At the end of the trial period, you must subscribe to continue accessing the platform.
3.2 Subscription Plans
- Monthly Plan: €10 per month, billed monthly
- Annual Plan: €100 per year, billed annually (17% savings)
All prices are in Euros (€) and include applicable VAT. One subscription covers unlimited children and parent accounts within your family.
3.3 Payment Processing
Payments are processed securely through Stripe. By providing payment information, you authorize us to charge your payment method for the selected subscription plan. You represent that you have the legal right to use the payment method provided.
3.4 Automatic Renewal
Subscriptions automatically renew at the end of each billing period unless cancelled. Monthly subscriptions renew monthly; annual subscriptions renew yearly. You will be charged the then-current subscription rate.
3.5 Price Changes
We reserve the right to change subscription prices with 30 days' advance notice. Price changes will not affect existing subscriptions until their next renewal date. Annual subscribers lock in their rate for the full year.
3.6 Failed Payments
If payment fails, we will attempt to charge your payment method again. If payment cannot be completed within 7 days, your subscription may be suspended or cancelled.
4. Cancellation and Refunds
4.1 Cancellation Policy
You may cancel your subscription at any time through your account settings or by contacting support. Monthly subscriptions: Access continues until the end of the current billing period. Annual subscriptions: Access continues until the end of the annual term.
4.2 Refund Policy
We encourage all users to take advantage of the 7-day free trial before subscribing. Due to the digital nature of our services and the free trial period, we generally do not offer refunds for subscription fees once charged. However, we will consider refund requests on a case-by-case basis. Please contact us with your concerns.
4.3 EU Consumer Rights
EU Right of Withdrawal: As an EU consumer, you have the right to withdraw from your subscription within 14 days of purchase without giving any reason. However, by using the service during this period, you expressly request that we begin performance, and you acknowledge that you will lose your right of withdrawal once the service has been fully performed.
5. Referral Program Terms
5.1 Program Participation
Participation in the referral program is optional. You may opt in via your parent dashboard after becoming a paying subscriber.
5.2 Earning Credits
You earn referral credits when someone signs up using your unique referral link and completes their free trial by becoming a paying subscriber. Credits are calculated based on tiered rewards (0.5, 1, or 1.5 months of subscription value per referral).
5.3 Using Credits
Earned credits are automatically applied to your Stripe customer balance and will be used toward your next invoice(s). Credits typically expire 12 months after being earned if unused.
5.4 Prohibited Conduct
You may not engage in fraudulent, deceptive, or abusive referral practices including creating fake accounts, spamming, or misrepresenting the service. We reserve the right to withhold or revoke credits and terminate accounts that violate these rules.
6. User Responsibilities and Conduct
6.1 Acceptable Use
You agree to use unschoolly only for lawful educational purposes. You will not:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Transmit harmful code, viruses, or malware
- Attempt to gain unauthorized access to our systems
- Resell, redistribute, or commercially exploit the service
- Use the service for any unlawful or fraudulent purpose
- Impersonate others or provide false information
- Interfere with other users' access to the platform
6.2 Content You Submit
When you submit information (e.g., child profiles, learning preferences, feedback), you grant us a non-exclusive license to use this information to provide and improve our services. You represent that you have all necessary rights to submit this information.
6.3 Parental Responsibility
As a parent or guardian, you are responsible for supervising your children's use of lesson materials generated by unschoolly. While we strive for accuracy and age-appropriateness, AI-generated content should be reviewed before use.
7. Intellectual Property Rights
7.1 Our Intellectual Property
The unschoolly platform, including its software, design, text, graphics, logos, and other content, is owned by unsch and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
7.2 Generated Content License
Lesson content generated through unschoolly for your personal use is licensed to you for non-commercial educational purposes within your family. You may print, download, and use this content for teaching your children. You may not resell, redistribute, or publicly share generated content without permission.
7.3 Trademarks
"unschoolly" and our logo are trademarks of unsch. You may not use our trademarks without prior written consent.
8. AI-Generated Content
8.1 Nature of AI Content
Lessons are generated using artificial intelligence technology. While we strive to provide high-quality, accurate, and age-appropriate content, AI-generated materials may occasionally contain errors, inaccuracies, or content that requires review.
8.2 No Guarantee of Accuracy
We do not guarantee that all generated content will be error-free, complete, or suitable for every learning situation. Parents and educators should review and adapt content as appropriate for their children.
8.3 Educational Tool
unschoolly is an educational support tool and does not replace professional educational judgment, qualified teaching, or parental oversight.
9. Limitation of Liability
9.1 Service Availability
We strive to maintain continuous service availability but do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or technical issues.
9.2 Limitation of Liability (EU-Compliant)
To the extent permitted by Estonian and EU law:
- We are not liable for indirect, incidental, special, consequential, or punitive damages
- Our total liability is limited to the amount you paid for the service in the 12 months preceding the claim
- We are not liable for losses resulting from unauthorized account access if you failed to maintain adequate security
9.3 Exceptions to Limitations
Nothing in these Terms limits or excludes our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any liability that cannot be limited or excluded under Estonian or EU law; or (d) consumer rights under mandatory EU consumer protection laws.
10. Warranties and Disclaimers
10.1 Service Warranty
We warrant that we will provide the service with reasonable care and skill. If you are an EU consumer and the service does not conform to this warranty, you are entitled to remedies under EU consumer law.
10.2 Disclaimer (Subject to Consumer Rights)
To the extent permitted by law, the service is provided "as is" without warranties of any kind beyond those stated above. We disclaim warranties of fitness for a particular purpose, accuracy, or non-infringement, except where such disclaimers are prohibited by law.
11. Data Protection and Privacy
Your use of unschoolly is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We process personal data in accordance with the GDPR and applicable Estonian and EU data protection laws.
12. Termination
12.1 By You
You may cancel your subscription at any time as described in Section 4.
12.2 By Us
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for other legitimate reasons. We will provide reasonable notice unless immediate termination is required for security or legal reasons.
12.3 Effect of Termination
Upon termination, your right to access the platform ends immediately. We will delete your personal data in accordance with our Privacy Policy and data retention obligations.
13. Dispute Resolution and Governing Law
13.1 Governing Law
These Terms are governed by the laws of Estonia and the European Union. EU consumer protection laws apply if you are an EU consumer.
13.2 Dispute Resolution
We encourage you to contact us first to resolve any disputes informally. If informal resolution fails, disputes will be resolved through the courts of Estonia.
13.3 EU Consumer Rights
EU Consumers: If you are an EU consumer, you may also bring legal proceedings in the courts of your country of residence. You may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
14. Changes to These Terms
We may update these Terms to reflect changes in our services, legal requirements, or business practices. Significant changes will be communicated via email or a prominent notice on our platform at least 30 days before taking effect. Your continued use after changes take effect constitutes acceptance.
15. General Provisions
15.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and unsch regarding the use of unschoolly.
15.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
15.3 No Waiver
Our failure to enforce any provision does not constitute a waiver of that provision or any other provision.
15.4 Assignment
You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.
15.5 Language
These Terms are provided in English. In case of any translation, the English version prevails.
